Civil Rights

Our civil rights cases make national and international news.

They have been reported on by the New York Times, Washington Post, Time Magazine, Newsweek, Rolling Stone, Billboard, The Associated Press, CNN, NBC, The Hill, and more local news outlets than we can count. We have obtained millions in settlements and verdicts in representing incarcerated people and the families of deceased prisoners for unconstitutional jail and prison conditions and wrongful death and catastrophic injuries resulting from unsafe conditions. We have represented many individuals who were unlawfully arrested or victims of excessive force at the hands of law enforcement, and we understand what a betrayal of trust it is when police and other law enforcement officials abuse their power. We also understand that many attorneys won’t listen to stories like this either because the cases are too complex or because they don’t want to take on government agencies and law enforcement. We will.

We have a special interest in cases where individuals have been denied medical care in jails and prisons. It’s all too common a story, an individual is arrested, sometimes unlawfully, and the suffer from a medical condition. Maybe their condition isn’t even serious or is controlled easily by medication. The person asks for medical care, then begs for medical care, then others beg on their behalf as even other prisoners see what is happening while guards and medical providers do nothing. Then, without care, the person dies or suffers a catastrophic injury. Problems breathing, heart conditions, blood clots, eye conditions, seizure disorders, psychiatric disorders, broken bones, infections, and medication side effects are just among a few of the easily treatable medical conditions that we have seen cause catastrophic injury or death in jails, prisons, schools and mental hospitals. We have obtained millions for those clients and their families. We have sought and obtained justice for people who have died, lost the use of a limb, been blinded, had seizures, lost the ability to breathe unaided, suffered traumatic brain injuries, and endured unimaginable suffering because of the callous disregard of jail and prison officials and medical contractors.

We routinely represent people with disabilities who have been subjected to discrimination and abuse in schools, mental health facilities, jails, prisons, and anywhere else charged with the care and protection of the rights of people with disabilities, and we have represented people subjected to forced labor in such facilities including residential treatment facilities in the “troubled teen” industry. We even have significant experience in First Amendment law. We have successfully challenged unconstitutional laws.

We generally do not take on small cases where the individual is not seriously injured or has not been subjected to unlawful confinement, conditions, or abuse for extended periods of time. The exceptions are situations in which large groups of people are affected in the same way. For example, we successfully obtained both money damages and a significant overhaul of a jail management system where faulty computer software resulted in the illegal detention of hundreds of people for periods of time ranging from a day to months. When we can’t take a case, it isn’t because we don’t care. It is because we focus all of our resources on cases that can have the most impact to change the way that law enforcement, education, and mental health systems work to protect the people in their care and control. There are plenty of lawyers who can accept smaller cases. Even if we aren’t able to help you, call us and we will be glad to give you a referral to a competent lawyer that can handle your case. However, if you have a serious injury or a loved one has died as a result of a civil rights violation, our deep knowledge of civil rights law, tenacity, and small case load has earned us a nationwide reputation of aggressively litigating these types of cases on behalf of individuals and families.

We understand the issues involved in these types of cases and more importantly, that this could and probably will be our client’s only shot at receiving all the compensation they deserve and desperately need to replace a love-one’s lost income or provide a life-time of care to a catastrophically injured person or to obtain justice for a deceased loved one. Unlike most attorneys, we have extensive experience and expertise in these types of cases and practice all over the United States. Sometimes our clients have called dozens of other law firms looking for attorneys with this expertise who will even listen to their story, but we hope to be your first and last call.

If you think you have a civil rights claim, call us. We will review your situation and give you an honest assessment of your potential case free of charge.
